[TRANS] 110217 Courts Dismiss All SM Injunctions & “Legally Guarantee JYJ’s Independent Activities”

The Seoul District Courts has dismissed all formal objections against JYJ’s injunction as well as the exclusive contract suspension injunction filed by SM Entertainment against JYJ’s Kim Jaejoong, Kim Junsu and Park Yoochun.

On the 17th, the Courts made it known that they have dismissed all claims filed by SM Entertainment, which is the agency’s formal objection against JYJ’s injunction as well as its exclusive contract suspension injunction.

This means that the Courts have emphasized their decision that the contract signed between the members of JYJ and SM is invalid and that the members’ independent activities are guaranteed. They have also publicized that SM Entertainment cannot interfere with JYJ’s activities in the entertainment activities on the claim that their contract with the agency is still valid.

The Courts laid down the verdict that SM Entertainment’s formal objection is invalid on the premise that:
▲the exclusive contract in question can be categorized as a submissive contract as it does not give the celebrity the freedom of choice and instead forces him to follow the orders of the entertainment agency
▲the members of JYJ could do nothing but follow SM’s orders as they were placed in an inadequate position compared to SM in terms of bargaining power
▲the exclusive contract’s extreme long-term subordinate nature cannot be justified by pretexts including the decrease of investment risks and ensuring a stable entrance into foreign markets
▲other than the long-term nature of this exclusive contract, clauses including that which gives SM Entertainment direct superintendency over JYJ’s every move as well as that which calls for excessive compensation for a breach of contract strengthen the submissive nature of this contract and place the members of JYJ in an unilaterally disadvantageous position.

Regarding the injunction filed by SM to suspend the exclusive contract signed between the members of JYJ and C-JeS Entertainment, the Courts dismissed the injunction on the grounds that:
▲as long as the verdict made on October, 2009, which includes the decision that SM must not interfere with JYJ’s independent activities in the entertainment industry, is valid, SM’s request to suspend the validity of the business commission contract signed between the members of JYJ and C-JeS Entertainment is not allowed as it goes completely against the previously stated verdict
▲and stressed that SM cannot exert the direct superintendency, given to them by their exclusive contract, over JYJ’s activities in the entertainment industry as of now.

[INFO] 110210 JYJ Takes 4 Spots In The Top 20 Charts For 2010 Without Any Broadcasting Activities

The group JYJ (Jaejoong, Yoochun, Junsu) gained attention as they took up 4 of the Top 20 spots on the Gaon Chart Total Album Sales for 2010.

JYJ’s Worldwide Album “The Beginning” recorded sales of 99,903 and took 8th place, with “The Beginning (New Limited Edition)” and “Luxury Edition” recording sales of 98,311 and 92,649 at 10th and 11th place respectively.

Also, the OST for KBS 2TV’s Drama “Sungkyunkwan Scandal” which starred Park Yoochun, sold 76,951 copies, and was at the 13th placing. It was the only OST that made it on the chart.

For JYJ, who is embroiled in a lawsuit with former management company SM Entertainment, who have been restricted from participating in music show recordings and other broadcasting activities, these are their results and rankings. This is the difference between them and other artists. And this also shows the existence of JYJ’s strong fanbase and star power.

On another note, “The Beginning” which saw contributions by the world-famous artist Kanye West, as well as the famous producer who worked with Michael Jackson, Rodney Jerkins, has garnered attention not only from the fans but also from people in the recording industry, even before sales had started. It was also ranked 5th in the American Billboard Chart for Readers’ favourite albums of 2010.

JYJ’s Kim Jaejoong has recently become the center of attention when it was uncovered that he’s being considered for a role in the drama ‘HanBanDo’ with top actors like Jang Dong Gun and Ha Jiwon. According to a representative of JYJ, not only will Kim Jaejoong be acting this year, but Park Yoochun and Kim Junsu will also take a stab at acting as well.

First up is Kim Jaejoong, who is a strong candidate for the drama ‘HanBanDo’ and one who acted in the drama ‘Sunao Ni Narenakute’ with famous Japanese actors such as Eita and Ueno Juri. Having built his foundation through the movie and drama he has appeared in as an actor, Kim Jaejoong is a rising star full of potential who is catching the eyes of drama representatives. A JYJ spokesperson stated, “Jaejoong is getting many love calls from production companies who have been keeping an eye on him as he has been gaining more experience in acting,” and “Many scenarios have come in, for movies and for drams. He has been receiving great offers in the drama genre so he is carefully considering his options. There is a high possibility that he will greet viewers through a drama in the later half of this year.

Park Yoochun, who successfully transformed into an actor through his role in the KBS drama ‘SungKyunKwan Scandal’ last year, is also planning to tackle a drama this year. The representative stated, “He has been receiving countless love calls after his role in ‘SungKyunKwan Scandal’,” and “As his first work was a historical drama, he is waiting for a new drama in which he can show a different kind of charm. Viewers will be able to see Yoochun in a drama, at the latest, in the second half of this year.”

Park Yoochun took the role of ‘Lee Seon Joon’ in the drama ‘SungKyunKwan Scandal’ and was praised for his acting, which was much more sophisticated than that of other rookies. As a result, he received three trophies at the 2010 KBS Drama Awards and proved his enormous potential as an actor.

Kim Junsu, who began performances for the musical ‘Tears of Heaven’ on February 1st, is planning to continue his remarkable activities on stage. The representative stated, “Though he is receiving offers for dramas and movies as well, Junsu wishes to and is planning on continuing his activities as a musical actor,” and “He has already proved his immense ticket power as well as his acting skills through various performances. Right now, his focus is to finish ‘Tears of Heaven’ well. He may greet audiences once more through a different musical in the second half of this year.”

Like so, JYJ are planning to be extremely active this year, branching out into the field of acting while continuing their careers as musicians. As all three have proved their potential, representatives of the industry believe that they will be as flawless as actors as they are as singers.

[NEWS] 101116 JYJ for Cosmetics Exclusive Model Activities ‘The Publish of Undisclosed Photobook – Postcards’

Being the successor of Rain, three members of JYJ (Jaejoong, Yoochun, Junsu) who become the exclusive model of one cosmetics brand will publish the undisclosed photobook and postcards to public for the first time.

It’s reported that cosmetics brand N starting from November 18th will unfold photobook and postcards event of their exclusive model JYJ through all stores nationwide and also the brand’s on-line shopping mall.

JYJ worked for the photobook and postcards commercial shoot in last September with the famous photographer Mr. Hong Jang Hyeon, and all unreleased pictures from the shooting will be revealed through the upcoming photobook and postcards release.

Jaejoong, Yoochun, and Junsu conducted the photograph shooting according to ‘JYJ in NATURE REPUBLIC’ theme in which the members showed their overflowing pure charisma just like a young child.

[NEWS] 100902 JYJ Raised as Music Bank Top 1st Candidate Without Promo Activities

JYJ (Jaejoong, Yoochun, Junsu) who just released OST recording song for KBS Drama ‘SungKyunKwan Scandal’ entitled ‘Chajada’, blew hot issue as the song notched top candidate spot on the 1st October broadcast of KBS 2TV ‘Music Bank’.

For a drama OST to climb up top candidate spot in music program is already a very unusual one, especially when this song is not even promoted due to the current situation surrounding JYJ, therefore this can be said as an extraordinary accomplishment.

In regard to support Micky Yoochun’s formal acting debut, Xiah Junsu and Youngwoong Jaejoong participated in ‘SungKyunKwan Scandal’ OST which was shortly after its release on September 16th, continues occupying offline music charts and has been sold over 110,000 copies. The jackpot of this album just continues marching forward.

JYJ shared their impression, “Despite the continuing difficult situations, we thank our fans for keep supporting and backing us up. [NEWS] 100928 Ain't No Stopping TVXQ's Trio In China


Despite setbacks in their activities in Korea and more recently Japan, TVXQ's trio, Xiah Jun-su, Micky Yoo-chun, and Hero Jae-joong, have no plans of stopping their activities in China.

According to news sources in Shanghai, China, the three segregated members of the idol group TVXQ are planning on participating in the 2010 East Asia All Stars Concert. This bit of news comes during a bad time for the trio. It was just announced on the 16th that they were forced to put a halt to their Japanese activities. This left Chinese fans on the edge of their seats in fear that China was next to be affected. Reps of the the three confirmed that because AVEX (the company overseeing their activities in Japan) is not in any way related to their activities in China, Chinese fans can rest at ease.

The last time the three members were able to greet their fans in China was in 2009 for their Asia Tour "Mirotic In Shanghai". This upcoming event will be a long-awaited reunion of the trio and their fans in the country abroad.

Previously preparing for the release of their “world-wide” album, the members who are at their peak - Micky Yuchun, Xiah Junsu, Hero JaeJoong, spill their hearts out about their feelings of obligations regarding their overseas activities, attracting attention.

Recently,Micky Yuchun, Xiah Junsu and Hero JaeJoong took part in the relay interview that was carried out at the G20 Seoul Summit’s formal blog, and clarified that, “The overseas fans don't just listen to our songs, but because to Korea, they are treasured, and they provide help, as singers who represent Korea, we especially feel a lot of responsibility towards our overseas activities.”.

Subsequently, they made an additional remark, “ Nowadays, other than Hallyu stars, there are also many Koreans who are being noted of by the world. As we feel indebted to the fact that the good feelings people have towards Korea are increasing, we will work hard to be more careful and do better.”.

Currently, Micky Yuchun is acting in KBS 2TV’s “SungKyunKwan Scandal”, and is carrying out the “Consideration Campaign” at the G20 summit. He responded to a sympathetic question about the situation, “While studying “Analects” to be able to speak like a Confucian scholar, in order to become a tranquil and important person, I am learning what kind of appearance should be possessed. To become a greater citizen of the Republic of Korea, it seems that it will be important to have the attitude to remain faithful to the system and pay careful consideration to the ways of the older times.”.

Xiah Junsu is in charge of the “throw rubbish into the rubbish bin” etiquette, and Hero JaeJoong is in charge of the “when you bump into a passing stranger, be able to apologize” global manners.

In particular, Hero JaeJoong added, “While carrying out activities in Japan, I saw many people who possessed the mannerism to have understanding all the time, even for small issues. [TRANS] 100927 JYJ's Activities in China Not Affected

It was reported on the a local newspaper in Shanghai that 'TVXQ's trio will be participating in the 2010 East Asia All Stars Concert in Hongkou Stadium in Shanghai on October 23rd'.

Since Avex announced the suspension of the trio's group activities in Japan on the 16th, many fans have been worried that the trio's promotions within Greater China will be affected. However, it was revealed to us that 'despite their current situation in Japan, all activities within Greater China will not be affected; they are managed by East Asia Entertainment, not Avex.'

It has been a year since Jaejoong, Junsu and Yoochun have performed in Shanghai. Their last visit was during 'Mirotic in Shanghai' in 2009. It is likely that many Chinese fans will be gathered this time around to see the TVXQ trio.

The three members of TVXQ signed with Hong Kong-based company East Asia Entertainment earlier this month and will officially be starting up their promotions in Greater China!

[INFO] 100927 TVXQ’s Xiah Junsu gains strength from members for solo activities

Currently preparing for his musical entitled “Kim Junsu Musical Concert-Levay with Friends,” TVXQ/JYJ’s Xiah Junsu recently stated that he receives strength through his fellow members.

Earlier today at Seoul’s Choong Mu Art Hall, Xiah’s held an open practice session which several media outlets came to report on (think of it as a press conference but with more action). During the session, he performed several numbers from his previous musical “Mozart!” for his guests.

In addition, Xiah stated – which many Cassies would be happy to hear – that he receives his strength from his members. To be exact, he said, “Just watching the image each of us go through our activities gives me support and cheers me on,” as he sent on his thanks to his members.

(Note: He did not specify JYJ nor TVXQ as a whole but we’d like to think that he’s talking about the latter group.)

In regards to working on musicals, Xiah said, “Musicals have given me a lot of courage and strength…Through musicals, I can sing and another one of my dreams have come true…I want to cry and laugh with my fans; in essence, I want to breath with my fans.”

“Kim Junsu Musical Concert-Levay with Friends” is set to premiere at the Seoul Olympic Gymnastics Stadium next month from the 7th to the 10th!

[NEWS] 100917 Three Members of TVXQ Face Setback in Japan

Three members of TVXQ, Micky Yoochun, Xiah Junsu and Hero Jaejoong, confront a fresh setback as its Japanese management agency Avex on Thursday decided to suspend all activities in Japan of the popular entertainers.


The surprising decision by Avex came just a week after the three members released an album in Japan last Wednesday, which stole the first slot on the Oricon Weekly Chart.

The latest development underscores the difficulties the stars face after the Seoul Central District Court ruled in favor of the three members against SM Entertainment, over an allegedly unfair clause in their contract. Since the legal dispute, the three members have kept their presence in the Japanese entertainment market, with Avex the local agency for the breakaway group, excluding two other members.

The relations between the three members and Avex, however, turned out to be not so amicable as the Japanese agency abruptly announced on Thursday it will stop promoting and organizing events for them, citing concerns about the head of C-JES, a Korean management agency.

“In order to obey the morals of working principles in our company, we have decided we cannot continue the promotions of the three members in Japan,” said an Avex spokesperson Thursday.

Avex also mentioned the criminal record of the Korean agency’s chief in its press release, when announcing its decision to halt management services. However, a PR representative in Seoul for Yoochun, Junsu and Jaejoong told The Korea Herald on Friday that Avex aims to block the group from performing for Japanese fans by suspending the service, rather than scrapping the contract.

Unless Avex terminates the contract, the three members cannot sign a new deal with other Japanese management agencies.

The three celebrities, who have a huge following in Korea, Japan and elsewhere in Asia, strongly refuted Avex’s statement on Friday, saying that C-JES has nothing to do with a criminal organization. They acknowledged the president of C-JES had indeed got a criminal record, but said the rumor about his involvement with an organized crime ring is totally groundless.

The members continued to argue that Avex already knew the agency chief’s past record when the two parties signed their contract. Given the circumstances, Avex cannot use this as a reason to suspend their activities, the members said.

The key point of contention between the three members and Avex concern the terms of the contract. Avex called for a change to the details in it, which the members declined, claiming the new conditions were unfair. The TVXQ members said Avex’s move is simply to punish their refusal to agree to new terms.

¡¡ Avex also stated in the press release that although it suspends service for the three members, it holds the legal rights to serve as a management firm in Japan for TVXQ group, with the full five members, citing the valid contract with SM Entertainment.

“We need cooperation and attention from our fans,” the three members said in a statement. “We hope we will meet our fans as soon as possible.”

Im Sang-hyuk, a lawyer working for the Korean idol group members, said in a statement that Avex shouldn’t have put them in such a tight position. “I will put efforts into solving this problem so that the three members can resume their activities in Japan,” he said.

The three members of TVXQ filed a lawsuit against SM Entertainment over the validity of their contract. They claimed that a 13-year contract was excessively long and that earnings were not distributed fairly among them.

[TRANS] 100917 Interview With Trio’s Legal Spokesman Lawyer Lim Sang Hyuk

In an interview on the 17th, the trio’s legal spokesman and lawyer Lim Sang Hyuk revealed that, “Avex requested changes in the contract that the members found difficult to agree to in clauses regarding topics such as income distribution.”

Lawyer Lim Sang Hyuk also added, “At first, it was agreed that all activities performed by the three members would be scheduled and discussed by both sides, but Avex began asking for this to be changed so that Avex would have sole control of scheduling; Avex also requested additional changes that the trio felt were logically unacceptable”

Regarding Avex pinpointing the history of the head of C-JeS as the main reason for halting activities, Lawyer Lim explained that, “Mr. Baek, the head of C-JeS, willingly volunteered for his company to be excluded from the contract if his criminal record would become a problem, but Avex ignored such a notice,” and “Later, they deemed that it would be difficult to progress normally with Mr. Baek’s background.”

The TVXQ trio’s official statement said that, “Several months ago, Avex requested that C-JeS be excluded from the contract for such reasons, and the TVXQ trio agreed to such a request and actively participated in the discussions regarding the renewal of their contract with Avex in order to ensure that they would have smooth activities within Japan.”

Lawyer Lim stated, “When viewing the chain of events, there were many situations that could only be seen as Avex insisting that things go their way and their way only. If the opposition decides to retaliate, we will release additional information from our side.”

He also added that, “The essence of the current controversy is that an agency offered unfair conditions, contrary to what had been included in the previous contract, to their artistes. When these artistes refused to comply, the agency halted all activities, disregarding the members’ wishes,” and “It is disheartening to see that Avex is using the head of C-JeS, who is not affiliated with any gangs whatsoever, as a scapegoat to distract the media and public from the real problem.”

Lawyer Lim criticized that, “It is immoral to back the TVXQ trio, some of Korea’s most representative Hallyu stars, into a corner just because they cannot fulfill a company’s greed,” and strongly stressed that, “We will work hard to resolve this situation and allow the TVXQ trio to resume their activities in Japan.”

The TVXQ trio, Micky Yoochun, Xiah Junsu and YoungWoong Jaejoong, released the following official statement regarding Avex’s decision to halt the group’s activities in Japan.

1) The head of C-JeS has no ties to gangs whatsoever.

Though his previous conviction is true, it was not a verdict made regarding any ties with gangs. Avex was fully aware of this fact before their contract with the TVXQ trio was signed, and as this cannot be classified as a breach of the exclusive contract, it cannot become a reason to halt activities or cancel the contract.

Several months ago, Avex requested that C-JeS be excluded from the contract for such reasons, and the TVXQ trio agreed to such a request and actively participated in the discussions regarding the renewal of their contract with Avex in order to ensure that they would have smooth activities within Japan.

However, Avex put forth conditions that were unfair to the trio unlike their previous contract, and when the trio refused to accept such conditions, Avex stated the gang ties of the head of C-JeS as a reason for canceling the contract, and finally released an official notice stating that no more activities would occur.

While these details were being discussed, the TVXQ trio continued to diligently carry out all scheduled activities to keep their promise with their fans and worked hard to come to an agreement with Avex.

2) The victims of this situation are the TVXQ trio. Avex attempted to coerce the trio to comply to changes in the contract, but when the trio refused to agree to such conditions, Avex announced a halt in their activities with no regard to the trio’s opinions.

Since the signing of the contract with the trio till now, Avex has involved the TVXQ trio in various activities aimed at raising the agency’s income such as concerts, Xiah Junsu’s solo album, participation in another Avex singer’s music video, and the recent ‘The…’ album.

However, Avex has been putting forth unfair conditions to the TVXQ trio, contrary to what had been done in the past, for the past several months by using the past conviction of the head of C-JeS as a pretext, and when these conditions were rejected, Avex began discussions on canceling their contract and announced a halt in activities in order to corner the TVXQ trio.

This can be seen as Avex taking all the money that they can from the TVXQ trio and then proceeding to create a situation that makes it impossible for the trio to sign on with any other agency in Japan, thus blocking the trio’s path with regards to Japanese activities. The TVXQ trio had no intentions of stopping their activities in Japan, and the announcement made by Avex reflected only the thoughts of the agency themselves.

3) Avex has made an illogical statement that the contract between Avex and SM Entertainment regarding the five members of TVXQ is still valid though they would suspend Micky Yoochun, Xiah Junsu and YoungWoong Jaejoong’s contract.

Regarding this, Micky Yoochun, Xiah Junsu and YoungWoong Jaejoong stated that, “First of all, we are extremely sorry to have to bring our fans such news. Though we actively participated in discussions with Avex in order to come to an agreement, it is regrettable that an announcement to halt our activities in Japan had to be made. Due to this situation, we can’t shake the feeling that Avex used the three of us as money making tools rather than treating us like artistes.” They also stated, “We feel frustrated that we cannot promise our Japanese fans another meeting in the near future. We need active support and interest from our fans in order to resolve this situation. We hope to resume our activities in Japan and meet our fans again as soon as possible.”

Lawyer Lim Sang Hyuk of Sejong, the legal representative of the TVXQ trio, stated, “It is immoral to back the TVXQ trio, some of Korea’s most representative Hallyu stars, into a corner just because they cannot fulfill a company’s greed.
