[NEWS] 110218 K-pop trio JYJ scores legal battle win

JYJ members (from left) Xiah Junsu, Hero Jaejoong and Micky Yuchun on the cover of their mini-album “The…”

SEOUL: Korean pop trio JYJ is one step closer to their goal of extricating themselves from a 13-year contract with former employer, entertainment giant SM Entertainment, after a court victory on Thursday, reported Korean media.

SM Entertainment had previously filed an objection against an earlier court decision, which deemed the contract between the company and JYJ unfair and ordered SM Entertainment to stop interfering in JYJ’s activities.

The company claimed that it was illegal for the courts to prevent SM Entertainment from pursuing its interests, as laid out in the exclusive contract between the company and JYJ members Hero Jaejoong, Micky Yuchun and Xiah Junsu (all former members of SM Entertainment’s boy band Tong Vfang Xien Qi).

However, Korean courts dismissed SM Entertainment’s objection and upheld its October 2009 ruling that the trio are free to go about their activities without having to pay any damages to SM Entertainment as the contract between them was unfair.

Korean courts pointed out that the 13-year contract duration and clauses which heavily penalized artistes who wanted out of the contract, “could not be justified by the investment risk undertaken by the company” for signing the artistes.

The courts also turned down SM Entertainment’s request to suspend JYJ’s contract with their current employer CJES Entertainment, explaining that the request was submitted at a time when the court order for SM Entertainment to leave JYJ alone was still in effect, which made the request invalid.

After the court victory, CJES Entertainment Baek Chang Ju expressed that he was overjoyed JYJ will “no longer be plagued by accusations of double contracts” and thanked JYJ fans for their support.

JYJ member Xiah Junsu also tweeted that he was very grateful to the fans for “not letting go” and giving JYJ the strength to keep going.

An SM Entertainment spokesperson told Korean media that the company is still working to prove that its contract with JYJ is valid and that “the legal battle between SM and JYJ is not yet over”.

[NEWS] 101111 The Possibility of TVXQ Trio’s Return to Appear on Japan Live Stage?

According to EDGE STYLE magazine December issue that was printed on the 6th, the three TVXQ members Junsu, Jaejoong, and Yoochun whose Japan activities were suddenly suspended a while ago will plan to appear once again and conduct live performance in Japan in around mid-November.

On last October 12th the three members held a showcase performance at Korea University, Seoul. The showcase became a commemorative event that marked the official formation of the three members’ unit ‘JYJ’. Moreover, the group seems to have hidden desire to target the whole world as the goal of their activities. JYJ had traveled to Thailand, Hongkong, and many other countries including several United States regions to hold their worldwide showcase as a thank you event for all fans due to the smooth flow of their first album in market.

EDGE STYLE magazine successfully interviewed a relevant official of JYJ, and the official reported, “We actually have this plan under discussion. In mid-November, the three members will re-establish their status as foreign artists in Japan, and we will conduct several performances as many as possible.” Although the live stage is still under discussion, it looks like the days to finally watch ‘JYJ’ on stage again is not so far away.

EDGE STYLE’s editor in chief Watanabe Rio through his editorial model press stated, “We got this testimony from someone who has close relationship to TVXQ.” There are also other testimonies from the members’ staffs provided in EDGE STYLE December issue, forced us to gradually believe that the event will soon come true.

[NEWS] 100930 Avex's split with JYJ - An act of submission?

On September 27th, a news article by Japan’s Asahi News, titled, “DBSK’s comeback potential“, speculated that Avex dropped promotional activities with JYJ because their contract with JYJ hindered Avex’s recruitment of other Korean stars. The article specified that Avex supported JYJ, but this caused a breakdown in relations between Avex and SM Entertainment to the point where the latter signed SNSD with Universal.

In summary, Aera, the author of the article, postulates that Avex split with JYJ as an act of submission to SM Entertainment and other Korean entertainment corporations.

Aera wrote, “It is commonly accepted in Korea that companies spend millions to train and promote artists from their early childhood. Korea’s entertainment business finds it inevitable that contracts must be of a certain length to guarantee profit. JYJ’s split from SM through legal proceedings put a huge scratch on the face of SM and Korea’s business. When Avex salvaged JYJ, it was a direct confrontation with SM.”

“When SNSD and KARA signed under Universal, and 2PM followed up with Sony, Avex had to consider the lack of fresh Korean recruitment. In the end, they opted to drop the immediately, but minimally profitable, JYJ for a chance to sign the new generation’s ‘DBSK’.”

Aera continued, “Just like in Korea, where fame is but an overinflated bubble, when DBSK broke up, their fame took a massive hit. Even in Japan, JYJ’s activities drew negatives comments such as, ‘money hungry dogs’, and other severe criticisms“.

Aera concluded by questioning whether JYJ has a bright future ahead.

While it wasn't specifically stated on the page, it is likely that the article was based on this
Also, the title of this article on akp was 'Avex dropped JYJ because of SNSD?' but this was changed because I really just couldn't see the relevance. So in case anyone is wondering, yes, this is the same post.

Previously preparing for the release of their “world-wide” album, the members who are at their peak - Micky Yuchun, Xiah Junsu, Hero JaeJoong, spill their hearts out about their feelings of obligations regarding their overseas activities, attracting attention.

Recently,Micky Yuchun, Xiah Junsu and Hero JaeJoong took part in the relay interview that was carried out at the G20 Seoul Summit’s formal blog, and clarified that, “The overseas fans don't just listen to our songs, but because to Korea, they are treasured, and they provide help, as singers who represent Korea, we especially feel a lot of responsibility towards our overseas activities.”.

Subsequently, they made an additional remark, “ Nowadays, other than Hallyu stars, there are also many Koreans who are being noted of by the world. As we feel indebted to the fact that the good feelings people have towards Korea are increasing, we will work hard to be more careful and do better.”.

Currently, Micky Yuchun is acting in KBS 2TV’s “SungKyunKwan Scandal”, and is carrying out the “Consideration Campaign” at the G20 summit. He responded to a sympathetic question about the situation, “While studying “Analects” to be able to speak like a Confucian scholar, in order to become a tranquil and important person, I am learning what kind of appearance should be possessed. To become a greater citizen of the Republic of Korea, it seems that it will be important to have the attitude to remain faithful to the system and pay careful consideration to the ways of the older times.”.

Xiah Junsu is in charge of the “throw rubbish into the rubbish bin” etiquette, and Hero JaeJoong is in charge of the “when you bump into a passing stranger, be able to apologize” global manners.

In particular, Hero JaeJoong added, “While carrying out activities in Japan, I saw many people who possessed the mannerism to have understanding all the time, even for small issues. To carry out the Consideration campaign this time, if the fans too would carry out the feeling of consideration together with us, it would be great.”.

Wrapping up the G20 relay interview, Micky Yuchun, Xiah Junsu and Hero JaeJoong said, “We are very happy to participate in this world event to better inform Koreans…”

[NEWS] 100927 TVXQ Trio in Shanghai Concert Participation… Activity in The Great Land of China Seems to Continue

The TVXQ trio, Xiah Junsu, Youngwoong Jaejoong, and Micky Yoochun’s China activities is expected to continue.

Shanghai Daily newspaper on the 24th reported the attendance of TVXQ trio in a charity concert held in Hongkou Football Stadium, Shanghai called ’2010 Shanghai East Asia Flying Up Concert’.

On last 16th TVXQ trio’s Japan label AVEX announced that currently all Japan activities of the group is going to suspend. This announcement becomes a great concern to their fans in China as it surely turns to be a red light to the group’s activities in China as well.

However, the Daily newspaper stated, “Eventhough they’re suspended in Japan, but it won’t give any effects to their activity status in China as AVEX is not in charge on their activities here but East Asia Entertainment.”

It’s been a year since Xiah Junsu, Youngwoong Jaejoong, and Micky Yoochun were spotted after their Shanghai Asian Tour in 2009 ‘MIROTIC in Shanghai’. Therefore since it’s been a long time to meet the TVXQ trio, it’s expected that a large group of Chinese fans will gather in Shanghai for the concert.

TVXQ signed contract with East Asia Entertainment, the label that is affiliated with many famous HongKong artists such as Andy Lau, Leon Lai, Daniel Wu, Sammi Cheng, etc, in last September. With this, their full cover activities in Great China region is about to begin.

[TRANS] 100917 Interview With Trio’s Legal Spokesman Lawyer Lim Sang Hyuk

Image and video hosting by TinyPic

In an interview on the 17th, the trio’s legal spokesman and lawyer Lim Sang Hyuk revealed that, “Avex requested changes in the contract that the members found difficult to agree to in clauses regarding topics such as income distribution.”

Lawyer Lim Sang Hyuk also added, “At first, it was agreed that all activities performed by the three members would be scheduled and discussed by both sides, but Avex began asking for this to be changed so that Avex would have sole control of scheduling; Avex also requested additional changes that the trio felt were logically unacceptable”

Regarding Avex pinpointing the history of the head of C-JeS as the main reason for halting activities, Lawyer Lim explained that, “Mr. Baek, the head of C-JeS, willingly volunteered for his company to be excluded from the contract if his criminal record would become a problem, but Avex ignored such a notice,” and “Later, they deemed that it would be difficult to progress normally with Mr. Baek’s background.”

The TVXQ trio’s official statement said that, “Several months ago, Avex requested that C-JeS be excluded from the contract for such reasons, and the TVXQ trio agreed to such a request and actively participated in the discussions regarding the renewal of their contract with Avex in order to ensure that they would have smooth activities within Japan.”

Lawyer Lim stated, “When viewing the chain of events, there were many situations that could only be seen as Avex insisting that things go their way and their way only. If the opposition decides to retaliate, we will release additional information from our side.”

He also added that, “The essence of the current controversy is that an agency offered unfair conditions, contrary to what had been included in the previous contract, to their artistes. When these artistes refused to comply, the agency halted all activities, disregarding the members’ wishes,” and “It is disheartening to see that Avex is using the head of C-JeS, who is not affiliated with any gangs whatsoever, as a scapegoat to distract the media and public from the real problem.”

Lawyer Lim criticized that, “It is immoral to back the TVXQ trio, some of Korea’s most representative Hallyu stars, into a corner just because they cannot fulfill a company’s greed,” and strongly stressed that, “We will work hard to resolve this situation and allow the TVXQ trio to resume their activities in Japan.”

[TRANS] 100917 TVXQ Trio’s Official Statement On Avex’s Decision To Halt JYJ’s Japanese Activities

Image and video hosting by TinyPic

The TVXQ trio, Micky Yoochun, Xiah Junsu and YoungWoong Jaejoong, released the following official statement regarding Avex’s decision to halt the group’s activities in Japan.

1) The head of C-JeS has no ties to gangs whatsoever.

Though his previous conviction is true, it was not a verdict made regarding any ties with gangs. Avex was fully aware of this fact before their contract with the TVXQ trio was signed, and as this cannot be classified as a breach of the exclusive contract, it cannot become a reason to halt activities or cancel the contract.

Several months ago, Avex requested that C-JeS be excluded from the contract for such reasons, and the TVXQ trio agreed to such a request and actively participated in the discussions regarding the renewal of their contract with Avex in order to ensure that they would have smooth activities within Japan.

However, Avex put forth conditions that were unfair to the trio unlike their previous contract, and when the trio refused to accept such conditions, Avex stated the gang ties of the head of C-JeS as a reason for canceling the contract, and finally released an official notice stating that no more activities would occur.

While these details were being discussed, the TVXQ trio continued to diligently carry out all scheduled activities to keep their promise with their fans and worked hard to come to an agreement with Avex.

2) The victims of this situation are the TVXQ trio. Avex attempted to coerce the trio to comply to changes in the contract, but when the trio refused to agree to such conditions, Avex announced a halt in their activities with no regard to the trio’s opinions.

Since the signing of the contract with the trio till now, Avex has involved the TVXQ trio in various activities aimed at raising the agency’s income such as concerts, Xiah Junsu’s solo album, participation in another Avex singer’s music video, and the recent ‘The…’ album.

However, Avex has been putting forth unfair conditions to the TVXQ trio, contrary to what had been done in the past, for the past several months by using the past conviction of the head of C-JeS as a pretext, and when these conditions were rejected, Avex began discussions on canceling their contract and announced a halt in activities in order to corner the TVXQ trio.

This can be seen as Avex taking all the money that they can from the TVXQ trio and then proceeding to create a situation that makes it impossible for the trio to sign on with any other agency in Japan, thus blocking the trio’s path with regards to Japanese activities. The TVXQ trio had no intentions of stopping their activities in Japan, and the announcement made by Avex reflected only the thoughts of the agency themselves.

3) Avex has made an illogical statement that the contract between Avex and SM Entertainment regarding the five members of TVXQ is still valid though they would suspend Micky Yoochun, Xiah Junsu and YoungWoong Jaejoong’s contract.

Regarding this, Micky Yoochun, Xiah Junsu and YoungWoong Jaejoong stated that, “First of all, we are extremely sorry to have to bring our fans such news. Though we actively participated in discussions with Avex in order to come to an agreement, it is regrettable that an announcement to halt our activities in Japan had to be made. Due to this situation, we can’t shake the feeling that Avex used the three of us as money making tools rather than treating us like artistes.” They also stated, “We feel frustrated that we cannot promise our Japanese fans another meeting in the near future. We need active support and interest from our fans in order to resolve this situation. We hope to resume our activities in Japan and meet our fans again as soon as possible.”

Lawyer Lim Sang Hyuk of Sejong, the legal representative of the TVXQ trio, stated, “It is immoral to back the TVXQ trio, some of Korea’s most representative Hallyu stars, into a corner just because they cannot fulfill a company’s greed. We will work hard to resolve this situation and allow the TVXQ trio to resume their activities in Japan.”

[TRANS] Regarding the Suspension of the 3 Members’ Activities in Japan

An article from a Japanese Blog

I believe many have been surprised with the evening news.
The dome concert was a great success, and finally, we thought that we were able to see the light, so we are so sorry to hear the news.

(T/N: Avex’s Official Statement. Please click here for the trans.)

We knew that there were arguments on Max and Chiba’s twitter for many days.
I think..it seems a little bit late…but, Avex should have put their foot down regarding the issues.
It is the same as the announcement of the suspension of Tohoshinki’s activities, they have not disbanded, they have not quit their activities in Japan for the rest of their lives, it is just “a suspension”…
We are all used to wait, so if we hold hands, everything will be OK\(~o~)/
Well, the high walls come by one after another…
Oh, we could just overcome the difficulties.

The saddest of all should be the members themselves.
We fans should not cry, not complain. Let’s just wait together, feeling their pure love, which they gave us at the dome♪
We fans are the ones who could create the most emotional bridge for them.
During the difficult days, they smiled their lovely smiles, and showed us wonderful stages, even during the a-nation, which was boiling hot.
With those wonderful memories, I myself can go on living for a while^^
So, everyone, genchyana, genchyana (T/N: no problem)

Let’s cheer with all our might to the members who will be active in other countriesO(≧▽≦)O
We are living under the same sky~(^-^*))。。。

(few sentences omitted)

(Edit)
No problem. He conquers who endures~
After all these, they will not get defeated!
They, whom we love so much, are not that weak.
Even though they are stepped on, criticized, they will stand up again like weeds.
As they always have done…and will also do in the future, too.

And everyone.
You all are ~ so strong. (T/N: there were many supportive comments written by the blog followers at the timing the blogger was writing the edit part)
What happened to all of you? (Lol)
Nobody is writing negative comments.
Amazing~~I’m the one who was encouraged the most.
Thank you very much.
I want to send all your comments to them~(^-^*))。。。
Only our family members can be like this! (Lol)

When we all hold hands, we will not fall down.
We will not be beaten.

There are news flowing out from Korea.
Please do not believe in all the written contents.
There were articles saying “they can never be active in Japan in the future”.
It is a matter of common practice that some of them make a federal case out of small facts.

Everyone, “Keep your love in your heart” “He can who believes he can.”
Let’s believe and love them together, hand in hand.
★'.・.LOVE~(^▽^(^▽^*)~LOVE.・.・:☆

[TRANS] 100913 Why Cant We Listen To The TVXQ Trio’s Songs?

Raemong Raein, the production company of KBS drama ‘SungKyunKwan Scandal’, has stated that it will file a report to the Fair Trade Committee stating that the drama’s O.S.T, which TVXQ’s Xiah Junsu, Micky Yoochun and YoungWoong Jaejoong participated in, is currently unable to be distributed through online music sites due to a certain company’s unfair corporate practices.

Posted Image

A representative of Raemong Raein stated, “We contacted various companies with regards to the online distribution of the O.S.T, which the three members of TVXQ participated in, but we have hit a roadblock and are unable to progress,” and “We believe this may be the work of a certain company using unfair corporate practices so we are planning to report the case to the Fair Trade Committee for further investigations.”

Why can’t we listen to the TVXQ Trio’s songs online?=The three members participated in the O.S.T of SungKyunKwan Scandal, the drama which Park Yoochun (Micky Yoochun’s real name) is starring in, and recorded the song ‘Found You’. However, this song is not available on any of the major online music sites such as ‘Melon’, ‘Mnet’, ‘Dosirak’ and ‘Cyworld’.

There are 0 searches found for ‘SungKyunKwan Scandal ost’

This is unusual as most O.S.Ts are released with much advertisement and services as soon as the drama begins airing. Even the O.S.T of ‘Playful Kiss’, the MBC drama which began airing at a later date than SungKyunKwan Scandal, has already been distributed.

Playful Kiss OST

As Raemong Raein has been unable to find a suitable domestic distribution company, it is currently reaching out to foreign label companies.

Did SM have a hand in this?= Raemong Raein has pointed out the possibility of SM having a hand in the current situation. The three members are currently in a lawsuit with their agency SM Entertainment regarding their unlawful contract.

There are voices being raised now that SM is stopping the songs from being distributed through KMP Holdings, which was created by and consists of Korea’s top entertainment agencies such as SM, YG and JYP Entertainment.

A representative of one of the distribution companies stated, “From what I know, the music sites aren’t providing services for the O.S.T because KMP Holdings contacted them and asked them not to distribute the songs. In the process, they even stated that they would stop giving such sites rights to distribute songs from KMP Holdings singers if the O.S.T songs were released.”

A representative of another company stated, “There were a lot of companies interested in distributing SungKyunKwan Scandal’s O.S.T before the drama was aired but they all gave up because there were fears that they may be hurt by releasing the songs.”

The Fair Trade Committee has stated that it is willing to take on the case as soon as Raemong Raein files it. A top representative of the Fair Trade Committee stated, “We would have to investigate the finer details, but if a certain company is using their position in the industry to stop songs of a certain singer from being distributed, then the action will be deemed as unfair corporate practices.

On the other hand, SM is denying such speculations. A representative of SM stated, “I’m hearing all of this for the first time,” and denied the accusations.
